Overview
● Lee Wei Yung specialises in complex commercial, corporate and civil litigation matters. Armed with a Masters in Commercial Law, with a specialisation in Company Law and Corporate Finance Regulation, Wei Yung has ably represented a myriad of corporate and commercial entities. ● An experienced litigator, Wei Young has acted in matters involving shipping issues, the carriage of goods by sea and air and multimodal transport as well as major aviation accidents involving airliners. ● Wei Young has acted in insurance claims (marine & non-marine), oil and gas (all three streams) and engineering claims. ● Wei Young is a skilled mediator and arbitrator. He has been accredited by the Singapore Mediation Centre, and is also a civil, commercial and evaluative mediator accredited by the Royal Institute of Chartered Surveyors. ● Wei Yung enjoys running and involves himself in various kinds of community work including homeless outreach and pro bono work. Experience
● For a period in his career, Wei Yung was a Senior Officer in the Singapore Police Force, involved in the investigation of a wide range of criminal and “routine” cases. ● Wei Young brings with him a wealth of experience in servicing both local and multinational clients in both litigation and corporate work including corporate finance related regulatory advisory work. ● He is also a specialist in transport, shipping and aviation issues. The range of issues he has been involved with include: o shipping ▪ Charterparties, vessel construction, sale disputes o carriage of goods by sea, air, and multimodal transport o major aviation accidents involving airliners, o insurance ▪ Marine and non-marine o oil and gas (all three streams) o engineering claims |
Transport (Sea, Air and Land)
● Acted for a party in a claim for hire in a time charterparty matter involving issues of off-hire. ● Acted for parties in a freight claim for voyage charter and sub-charter. ● Acted for ship agents in matters involving payments for ship agency services. ● Acted for party in a dispute concerning ship fabrication and bow thrusters. ● Acted for forwarders in multimodal carriage of goods claims. ● Acted for an upstream oil company in a dispute concerning JOC commitments in exploration, drilling and production. ● Acted for oil rig and e-houses fabricator in a contract claim. |
● Acted for transporter and forwarder of oil rigs based out of Baku in a claim for freight.
● Acted for contractors of distillates, decant oil, gasoline involving a chain of oil majors, suppliers and NOC concerning supply of oil out of Indonesia in a matter involving multiple arbitration claims. ● Acted for passengers in aviation accident claims under the Unamended Warsaw Convention under Schedule 2 of the Carriage by Air Act (Cap 32A). ● Acted for cabin crew in an aviation accident claim. ● Acted for forwarders in a claim for freight in carriage of goods by air matter. ● Acted for warehouse and cargo handlers in a claim concerning air freighted goods. ● Acted for owners in seizure of vessels by Customs. |
Corporate Litigation
● Acted for party in minority oppression (unfair prejudice) matter involving issues of an O’Neil v Phillips offer and valuation of shares. An O’Neil v Phillips offer deals with situations where minority business members feel that their “legitimate expectations” have been disappointed and they are then provided with an offer to buy them out of the business by the majority shareholders. ● Acted for parties in a corporate litigation matter involving derivative action under s. 216A of the Companies Act (Cap 50). This Act affords protection for minority shareholders where their interests are oppressed by the way a company’s affairs are conducted or by how the company’s directors’ are exercising power. ● Acted for company against director involving issues of diversion of business and not acting in the best of the company. |
Corporate Finance
● Advisory work and drafting agreements on closed-end funds. ● Advisory work on physical delivery of foreign currency. ● Advisory work on licensing requirements under the Financial Advisers Act Cap 110,(which provides guidelines on the regulation of financial advisers in Singapore, including their representatives and supervisors) and issues of fund management. ● Advisory work on the coverage of the exemptions under s. 27(1)(d) of the Financial Advisers Regulations Cap 110. ● Advisory work on exemptions under the Security and Future Act Cap 289 which involves the regulation of activities and institutions in the securities and derivatives industry, including leveraged foreign exchange trading of financial benchmarks and of clearing facilities . |
Family Law
● Represented a party simultaneously involved in a family civil maintenance claim and a quasi-criminal claim for maintenance under the MSS scheme (Minimum Sum Scheme, CPF) amounting of about USD 4 million. |
Probate (Contested)
● Represented executor in a dispute between beneficiaries to a large estate valued at more than S$50 million. |
